- [Interviewer] So what happens after we get service
on the defendant?
- So once we get service on the defendant,
the next stage is we want to get the defense attorney
involved on the case.
They have 30 days to get in
after we get service on the defendant.
Typically the insurance company will hire the attorney
on behalf of the insured,
the person who is the defendant in this case,
and then they will file their entry
to say that they now represent the defendant.
And then reply to our lawsuit.
The reply is called an answer.
And typically they're going to say things in there,
some defenses as to why they don't think
that their defendant is at fault.
Or maybe why they should mitigate or make less the damages
that you have in this case.
The reason that they do that is because
every attorney does it,
because they wanna try to get a discount.
Similarly, what we do is we take them to court
on that answer if they do some of these affirmative defenses
saying that you maybe did something wrong.
Because I want to start the process early
to show that attorney that we are willing
to work hard on their case, to litigate this case properly
on your behalf so that we can get you
a fair and full settlement,
or if necessary take it to a jury trial
and get a fair and full verdict.
