Gifting and receipting - Gifts of service Website and software Charities Directorate

Let us look at a few examples explaining how to proceed when you receive a gift of a website or software.

Your charity hires a small software company to build a website to meet the specific needs of your charity. The company charges $250 per hour and the website will take 60 hours to build, for a total cost of $15,000.

Upon completion of the website, the company suggests that, rather than invoice the charity for payment, it will be willing to accept a donation receipt for $15,000.

Can you give a donation receipt to the software company for $15,000?

If you said "No," you are correct. Creating the website is a result of time, skill and effort, a nd donation receipts cannot be given for gifts of service.

Upon analyzing the charity's specifications, the small software company states that they have a pre-designed software product, a website template that was designed just for charities.

The software company sells this product for $3,000. The company is willing to freely donate this product to the charity.

If your charity accepts this as a gift, can you issue a donation receipt for the $3,000 software product?

Yes, you can issue a donation receipt for $3,000 as long as you have documents to confirm that this is the fair market value of the software product.

To summarize, what has changed between these two examples to allow a donation receipt?

In the first example, there is no product, just the need for time, skill and effort to create the customized product. In the second example, the software company has a finished off-the-shelf software product, a property that sells in a free and open market.

QuickBooks Products and Services Canadian example - Duration: 7:36.

Hi!

Kerry here from MyQuickBookKeeping.

One of the first things you want to do when you set up your QuickBooks' online file

is to create the products and services you'll be selling.

If you have not already done so, check out my video about personalizing your Chart of

Accounts.

When you've done that, you're ready to create the products and services you're selling

in your business.

Be sure to watch right until the end.

If all steps are completed accurately, it will also help with the accurate filing of

your sales tax returns and ensure you claim all the credits you're entitled to.

We're going to use a QuickBooks sample company again today, Long for Success – Event Planning.

See what products and services they offer.

Select the cog in the right top hand corner and choose Products and Services under Lists.

The services provided are split between Employee Events, General Services, Holiday Party, Promotional

Items, and Retreat.

Let's have a look at Silver Holiday Party.

It's a service that's sold to customers and posted to the account Sales.

That's not very imaginative!

Here's where you could have different income accounts set up to show a breakdown of sales

so you'd be able to run reports and see what percentage of your business came from

holiday parties, for example.

Note there's no tax selected here.

If you set a default tax code, it will be displayed every time you sell that product

or service.

That will save you time when you create invoices.

You will only have to edit it if the normal code does not apply.

Let's use the GST code.

Now, let's have a look at Product.

How about Guest Books?

Here we go.

This is an Inventory item and it has a SKU.

And account Quantity is 20.

You can enter a Reorder Point here so you don't run out of whatever it is that you sell.

Let's enter 10.

You will receive an alert for selling another 10 without reordering.

Next, we have a physical inventory of Guest Books.

They're included as an Inventory Asset.

They'll appear in our balance sheet in Costs.

And here is where it gets very interesting.

When we sell a guest book for $25, we'll have income under Sales of Product Income

for $25.

We will also record a cost of sales of $12.50.

And this amount will be reduced from the inventory.

If the term Cost of Sales is not clear, have a look at my video to understand the income

statement.

If you still have questions, then please send me a message, write a comment or reach out.

I'm thinking about writing a blog on terms that need further explanation, so it would

be great to know.

Now, let's set up a Service to use in this business.

Select New.

And to keep things simple, let's make it a Service.

Now, how about we add a Thanksgiving Holiday Party.

The name will be Thanksgiving.

It will be included under the category Holiday Party.

When you sell it, the invoice will say Thanksgiving Dinner.

Let's set a price of $1,500.

And now, we'll show it in, I guess, Sales.

Sales tax code we will apply to this item will be HST.

Let's go with Ontario.

Note that you should get proper advice about what to apply to your products and services

from your accountant and it will change based on where you live and where you sell to.

Now Save and Close.

In order to see how this works when we create an invoice, let's select Invoices across the

top here.

You could also access invoices from across at the top right hand corner.

Let's select the customer and we'll sell him a Thanksgiving Dinner.

Since this is a special occasion, let's add a Guest Book.

Here we go.

Here's our guest book.

And, as you can see, the default tax code is being filled in automatically.

Let's put this one in here too.

I'm going to change the date to next month.

Here we go.

Let's put it on October.

So I can run reports and show you how to sync tax to financial statements.

And now, we will save the invoice.

On the left hand tab, select Reports and choose Profit and Loss.

Let's use custom dating so we can find that transaction we just created.

Here we go.

And run the report.

And here, we have Sales $1,500, which was our Thanksgiving Dinner, Sales of Product

for $25, the Guest Book, and also we have the Cost of Sales of $12.50, which was the

cost of the Guest Book.

So by setting up the products and services, when we completed our invoices, it's easy

to select the items and our reporting was then accurately updated.

Now let's see how many Guest Books we have.

Scroll down here.

Oh look!

19.

It's all updated.

It works!

Now, without confusing things too much, let's have a look at the taxes.

There's another video to explain how to do this in detail so this is for illustration

only.

So let's change this date to include October.

Where are we?

Here we go.

Now we've got October.

That's it.

And we go in this tax collected.

And here we have our invoice.

The tax is being collected and everything will be ready once we come to complete our

sales tax return.

By setting up your products and services accurately at the beginning, your profit and loss in

the balance sheet will be correct and filing your sales taxes will be a breeze.

Now, let's have a quick look at the reporting you can get from the product section.

From the dropdown, select Run Report.

Now, if we scroll down, we can see the Thanksgiving Dinner.

Here we go.

And the Guest Book.

The Guest Book also shows the Cost.

So you're able to see the profit that you've made and also the quantity that you have left

on hand.

We certainly covered a lot.

Please don't hesitate to reach out if you have any questions or would like help getting

this set up.

I had two kids, I was a widow, I didn't know English.

It was tough.

And the first step was step was Northern Essex.

I wouldn't be able to do it without their help.

I didn't know what I wanted to do, but I knew it was something working with people.

I want to make a difference.

Northern Essex was right there, the cost is great.

The Human Services I feel like it's a very tight-knit community based on where you work.

The people I'm in class with are the professionals that I'm going to be next to when I do end

up, you know, getting a full-time job in the field.

Going to a counselor, it's something very personal, so I feel like this class especially

is giving us the skills to be able to make that personal connection with them.

Okay, I've learned all this but what am I going to apply it and that's when your internship

comes into play.

I'm taking my skill and incorporating what I've learned, modalities of treatment, behavioral

management, I know how to work with these people

because now you have the tools to know that.

I'm a helper naturally.

I want to be there for people who are going through the same situations.

They don't know the language or people don't understand the culture.

I do understand anyone I want to be there for them because there were people who were

there for me.

Pretty much every business requires someone in a human service professions.

I started out wanting to work with kids now I'm doing elder activities or I could go a

direction of Social Work and you could of anyone in Social Work you go into a domestic

violence advocacy program, alcohol and drug counseling, general counseling, there's literally

nothing you can't do with it.

I got to meet like great people, great professors, I feel like I'm getting experienced professors

who haven't always been in an academic setting they've been out in the field working they

can tell me what to expect, they can tell me how to deal with problems I might encounter.

They care about you individually.

I was thinking sometimes I'm not going to finish, I'm not going to do it, it's too much

but they always say it yes you can do it you're going to do it and I did it on time.

They've done a great job of making me feel like, all right now that I'm preparing to graduate

now I have that tool and I feel like Northern Essex gave me that tool in order to better

myself and hopefully better other people's lives.

I definitely feel like I have a good support team.

It's really well run and I feel like it definitely prepares me to be in the field.

I'm more confident now and now I started my master's degree at Salem State I did it there's

no reason other people can't and I thought I couldn't.

Northern Essex to made a difference in my life.

Gifting and Receipting - Services: are they receiptable? - Duration: 3:55.

Gifting and receipting - Gift of service Services: are they receiptable? Charities Directorate

This video will explain what are gifts of service and will cover examples on why they are not receiptable.

What is a gift?

A gift is a donation that is freely or voluntarily given. If a donation is made because of an obligation, it is not a gift.

Simply making a donation to a charity or other qualified donee is not enough for a donation receipt to be issued.

You also must decide if the donation involves a transfer of property. Gifts of property include cash or non-cash gifts like equipment, food, stocks and bonds, and so on.

Gifts of service are donated time, skills, and effort.

They are not a transfer of property.

Therefore; donation receipts cannot be issued for donations of gifts of service.

Although they are valuable to a charity, donations of time, skill and effort, are not considered a transfer of property.

Although I may freely volunteer my time, skill and effort, as an accountant to do your financial statements, you have not received any property.

Let's take a look at various scenarios to help make sense of how to handle gifts of service.

Tonya, a professional freelance journalist, offers to write several articles to support a fundraising campaign for your charity.

Her services are worth $500, but Tonya offers to accept an official donation receipt instead of a payment to help keep your charity's expenses down.

Can you issue an official donation receipt to Tonya?

No. You can't issue an official donation receipt because Tonya is donating her time, skills and effort, which are not property.

You need to build more shelves for bulk items in the food bank. You hire Joe's Carpentry Company to build the shelving at a cost of $500.

To help your charity, Joe's Carpentry Company wants to donate the building material worth $200 and charge only for the labour, which is worth $300.

Can you issue an official donation receipt for this kind of donation?

Yes, you can issue an official donation receipt for the building materials because it is a transfer of property. However, you have to determine the fair market value of the building materials.

After having paid Joe's Carpentry Company for its services, you receive a $300 cheque from the company in the mail. The $300 donation is the same amount you paid Joe's Carpentry Company for its services.

Can you issue a receipt for this donation?

Yes. You can issue Joe's Carpentry Company an official donation receipt for the cash donation of $300.

This cash donation is considered property which was given voluntarily by the company in a transaction separate from the carpentry services it provided. This is commonly called "exchange of cheques."

To summarize, you cannot issue receipts for gifts of services. There are no exceptions.

Circumstances where donation receipts can be issued for donations of property such as cash and non-cash gifts are explained more fully in our video, "Gifting and receipting 101."

TMIN News 06: Goods and Services - Duration: 6:29.

MARK TRADEMAN, TMIN NEWS ANCHOR: Confused about how to identify

your goods and services?

You're not alone.

Stay tuned for some important tips and keep in mind...

Correctly identifying your goods and services is one of the most

critical aspects of your application.

A failure to correctly list the goods and services with which

you use the mark may prevent you from registering your mark.

And you will not be given a refund.

If you're asking what an "identification" is or what is

meant by "goods and services," think about it this way.

What do customers purchase from you?

An actual physical product that bears your trademark?

Or do they hire you to perform an activity for them?

If it's products, you have goods.

If it's activities, you have services.

Although the determination of whether you have goods or

services can be confusing, it's critical that you make the

correct identification.

To help you along, let's look at an example that applicants often

find confusing: T-shirts and the silk screening of t-shirts.

Let's say you designed a bunch of t-shirts and you want to

sell them.

If a customer purchases one, you're providing

goods: t-shirts.

Note that the customer didn't pay you to perform an activity.

He paid you for a "thing." You, then, are a goods provider and

you'd want to identify your goods as "t-shirts."

On the other hand, let's say a customer has created a new

design that she wants you to print on a t-shirt.

If you do as she asks, you're providing a service: a silk

screen printing service.

Now, although the customer does end up with a t-shirt, she

didn't come to you to purchase a "thing." She hired you to

perform an activity.

You, then, are a service provider and you'd want to

identify your services as "Imprinting messages on

t-shirts" or "Silk screen printing."

But "Wait!" you might be asking.

"Don't I need to put down that I'm selling my t-shirts?"

The quick answer is "No." The selling of your own goods is

never a service, but the providing of a convenient place

to purchase goods is.

So, if you have a website or a retail store where you provide a

place for people to purchase goods, such as t-shirts, then

you'd want to identify "retail store services." For our example

here, your services would be "Retail store and online retail

store services featuring t-shirts."

See the difference between them all?

It can be confusing, but just remember: goods are things that

bear your trademark; services are activities that you perform

for others.

The Office has a listing of acceptable goods and services in

the Trademark Manual of Acceptable Identifications of

Goods and Services, it's also known as the ID Manual.

For guidance, spend a few minutes with the ID Manual and

see if the Manual contains an identification that accurately

reflects your goods and services.

If so, use that ID in your application.

Keep in mind, however, that "accurate" does not mean "overly

specific." Selecting the general category of your goods

and services is perfectly acceptable.

For example, if your goods are t-shirts featuring rhinestones,

you do not have to include the information about rhinestones in

your identification or e-mail the Office to have the ID added

to the Manual.

You may simply identify your clothing in the application as

"T-shirts" or "Shirts" or even "Tops."

If the ID Manual does not contain an acceptable listing

for your type of good or service, and you're applying

through either TEAS RF ("TEAS Reduced Fee") or TEAS Regular,

use the "free-form text" option to explain the goods and

services in your own words.

If you're applying through the TEAS Plus form (and the ID

Manual does not contain an acceptable listing), you have

several options.

You can e-mail the Office to see if the ID can be added to the

Manual or you can start over and use either TEAS RF or

TEAS Regular.

In any event, be aware that "close doesn't count." Merely

choosing an identification in the Manual that is similar to

your goods and services, but that does not accurately reflect

them, can cause major problems in your application and could

prevent the eventual registration of your trademark.

In addition, it's important to list the correct ID, because you

can't add goods and services later and you can't switch back

and forth between goods and services if you get it wrong.

Also remember that an ID should not indicate a "manner of use."

That is, the ID should not indicate how you intend to

market your goods and services.

So, unless you actually sell business cards to other people

or provide actual advertising services for other people, do

not write down "business cards" or "advertising." Your ID should

specify either the actual goods upon which your mark is used or

the actual services with which your mark is used.

Another common mistake is to list every type of good or

service within an International Class.

Doing this may cause major delays for your application.

You should only list the goods and services with which you are

actually using the mark or have a bona fide intent to use

the mark.

If you discover later on that you want to add additional goods

and services, you must file a new application to cover those

goods and services.

Essentially, although you can modify wording in your original

application to clarify the exact nature of your goods and

services, you cannot simply add goods and services to

that application.

Correctly identifying your goods and services is critical.

Take your time and choose carefully and wisely.

The registrability of your mark may depend on the ID that you

choose now.

Feel free to replay this broadcast and click on any of

the links within the form for more information.

And keep an eye out for more of these broadcasts throughout

the website.

Mom Let Her 3 Kids Play In The Backyard, Then Child Services Knocked On Her Door - Duration: 2:25.

Mom Let Her 3 Kids Play In The Backyard, Then Child Services Knocked On Her Door

Those of us who were fortunate enough to grow up in a home with a yard have a number of

happy memories attached to these experiences.

There are few things more pure and innocent than running outside with your siblings after

all of your chores and playing on swing sets or riding bikes.

This all sounds normal enough and when you find out why this mother from Manitoba had

Child Services called on her, you will be stunned.

Jacqui has a home with a yard and this yard is also fenced in.

When she sent her three children out to play, she never could have imagined what would end

up happening next.

Someone issued a complaint about her allowing these children to play outside without supervision

to Children and Family Services and from there, an investigation was launched into the matter.

When the CFS worker arrived to look into the situation, Jacqui was confident that she had

provided enough information to satisfy their understandable curiosity.

What she didn't know was that the incident had been recorded and added onto her permanent

record.

This yard is as safe as can be and is enclosed on three sides with wood, in addition to a

chain link enclosure on the other side.

The idea that these children are being left to their own devices for hours at a time is

a very erroneous one and we feel sorry for Jacqui that she even has to go through this.

Children do not need a parent hovering over them for every second of their play time in

order to be safe and there is no reason why someone should have felt compelled to report

this fine mother to the authorities

If the person was so terribly concerned about what was taking place at this woman's home,

why would they not take the time to speak with her first?

We may live in a crazy world these days, but that does not mean that children cannot play

outside without an armed guard standing over them.

This mother did nothing wrong in our opinion and we wish that people would learn how to

mind their own business.

This is a story that must be shared by all readers, so that nothing like this is ever

able to happen again.

Parents should be able to let their children roam their property without worry or fear

of reprisal from the authorities, as long as they have offered the proper enclosures

to keep them safe from potential harm or unwanted intruders.
