Hill this week is House Oversight Committee chairman trey Gowdy grilled
deputy AG rot Rosenstein on the Russian investigation saying it's time to wrap
this thing up if you have evidence of wrongdoing by any member of the Trump
campaign campaign present it to the damn grand jury whatever you got finish it
the hell up because this country is being torn apart Oh
so does he have a point let's bring in Alan Dershowitz harvard law professor
lifelong democrat and author of the case against impeaching term professor always
good to have you with us thank you look he speaks for a lot of Americans that
feel the exact same way at this point they're angry they're wondering what are
we still doing here what is your response well these kind of Special
Counsel investigations almost always take a long time that's one of the
problems with having a special counsel they start from scratch they don't have
people on board who are in the US Attorneys offices they have to organize
right from the beginning and the Clinton probe took a long time the iran-contra
probe took a long time so there's no surprise that this one's taking a long
time what is surprising is that rod Rosenstein is still supervising it more
and more information is coming out about his conflict of interest we've now seen
stories in The New York Times about how he may have regretted writ writing
letter and he felt he was used writing the letter he is a central witness in
this entire obstruction of justice if it involves the firing of : e how did he
still stay on the case I wish they would focus much more on that because he is
would use he is disqualified he ought to be replaced so professor Alexei however
slow the process down even more so pardon me there but so what would be the
remedy do you think first of all because you know if the president fires
Rosenstein as has been speculated before he's going to get in more political hot
water to look like he's hiding something so how do you deal with the fact that
Rosen Stein is conflicted as you say there are many ways of doing it number
one you could bring a lawsuit challenge has continued appearance as the person
who's supervising the whole investigation second you can bring in
ethics charge you can file an ethics charge with the bars to which he is a
member saying he has no ethical right to remain on the case but I just don't
understand if somebody who's taught legal ethics for over 25 years at
Harvard Law School the first thing you learned is you can't be both the
prosecutor and a witness it can so much influence your role as a prosecutor to
know that if the case goes a certain way then you are a witness as it goes
another way maybe you're not a witness you look terrible this way you look
better the other way he has real self-interest people talk about the
president not pardoning himself with the president not pardoning people who were
involved here you have the person who's leading the investigation who has an
obvious interest in the way in which the investigation is going to go involving
his own participation that just shouldn't be allowed professor Gerson
looks real quick um it looks like the president's gonna get a new a new
appointee to the Supreme Court and he's running up against a lot of opposition
what do you think he's gonna do well I think there are two questions about
right to life if he appoints somebody who believes that Roe versus Wade is
wrong but shouldn't be overruled because it's been the law for a long time that's
one thing second if he appoints somebody you think she'd be a rule and left to
the states that's the second thing but he might even appoint somebody who
believes there is a right to life a constitutional right to life which would
mean that the president the Supreme Court would rule that no state could
even permit abortion that New York and California would have to abolish their
laws permitting abortion if there is a constitutional right to life then states
wouldn't have the power to permit women to have abortions and we have to know
what the president's position is on that is he an Tyrol rate Roe versus Wade
number one that is it's wrong but it shouldn't be a rule number two it should
be overrule or there is a right to life which means that you can't have abortion
in any states we have to know where the president stands on that day and whether
his appointee represents anyone of big issue no doubt in all of this and

legal analyst Greg Jarrett let's start with you from the legal standpoint I
captured a lot of inconsistencies and I know you did well one could say they
were lies by Rod Rosenstein for example he denied ever threatening members of
the Intelligence Committee and the staff in a January 10th meeting in which he
threatened to get his hands on their emails texts and phone records that's a
little scary in America I talked to two people who are in on that meeting they
used the word threatened and that he said he was threatening to obtain those
texts and emails and so forth so that did not appear to be terribly truthful
by him he also wasn't truthful when he said I'm not withholding any evidence of
subpoenaed records well his own letters refusing to turn over the documents or
evidence that he's withholding and yet he said I'm not withholding there wasn't
a lot of truth in Rod Rosenstein today let me go get your initial reaction
Sarah Carter I think that when trey gowdy when representative trey Gowdy
questioned him and made a statement saying if you have any evidence of this
rod Rosenstein let's just get it out right now stop dragging the American
public this administration in our country through the mud if you have
evidence that anything happened with the Trump administration with President
Trump you know get it out there let us know what it is but he never once has
done that and if you look at the IG report shine and you look at what
happened today on Capitol Hill and how he evaded and avoided questions and I
tell you Greg is 100% right I've spoken to similar sources who
I've been in those backroom meetings one person - that was personally the victim
of the temper tantrum absolutely a direct conversation that was related to
me so rod Rosenstein flat-out lied he lied
to Congress and he lied to the American people and we just got a call a spade a
spade call it what it is and if you look at the IG report I want to go back to
that really quick and we look at struck himself I was looking at it in more
detail in talking with some sources tonight and you know there's one point
we're struck tries to explain the insurance policy question remember in
August that text message that he sent to Lisa Paige about having an insurance
policy and talking with Andy McCabe and he explains it away as saying well we
were talking about how aggressive we were going to be or how a work we were
going to be with this investigation and when I was talking to FBI sources about
this they said that is so telling because at that moment in time when he
let that out to Horowitz when he made that statement he was basically saying
we're gonna go after Trump even if it means going after the people around him
even if it means putting disinformation out there in the media even if it means
arresting people for crimes that were committed ten years ago or maybe they're
not even crimes but just giving that or around the president so the chaos here
really has been the FBI and the people on the seventh floor and the DOJ and not
even so much the Russians anymore I mean the real chaos in our country is coming
from them you know Rosen's he said I'm not trying to hide
anything you know I like it let me I just made a short list and I wrote it
down before the show okay we'll stop Trump they hid that from everybody for a
period of time war he withheld the fact that struck was a personal friend of
Judge Rudolph Contreras which you mentioned on this program last night
they refused to initially remember he begged up to the last minute Paul Ryan
not to release what became the new Nest memo which told us about FISA abuse the
DOJ tried to hide from Congress the fact that two of the most important
investigators on both the hillary and russia probes with vehemently antitrump
'i didn't want that out either and remember December 2017 five months after
struck and Paige was shoved out the door it was the Inspector General that
released the struck that's right page text and
that's what we is shortlist regs and what did Rosen Stein say of the behavior
of Peter structure day he called it inappropriate which has to be them both
lhasa understatement of all time especially when you consider the IG said
that this is a man who had a willingness to abuse his position of power to
influence an election and but to rod Rosenstein oh it you know it's just
inappropriate things that stand out we both we all three of us have talked to
at least one person I've talked to one you talked to two Sara how many sources
do you have about his temper and that he made the threat that he denied today I
have at least four sources okay well you're working harder than both Greg and
I use himself then structs actions is you just pointed highly inappropriate no
that would be rigging an investigation to influence a presidential election and
as your book says the scheme to clear Hillary and frame Trump that's what
happened Rosen Stein said today if it's appropriate I'll recused myself it was
appropriate long time ago I'm ago he is a witness investigator
prosecutor judge and jury all rolled in the one that again he is the witness
he wouldn't decides whether any charges would be brought
why is he why is he like mad at me by name and not you and Sarah election they
tried to undermine it to favor one candidate and screw the other candidate
that's why this matters and why the rest of the field ignore this story I don't
know Shawn it matters because they they weaponized they weaponized our tools of
law enforcement the the NSA the CIA the FBI and everything else I mean this is
such an enormous investigation we haven't even talked about the unmasking
yet so they recognized the tools I know and they weapon we need to get back to
that we need to have answers if the United States is going to move forward
if we're going to clean up our system our FBI and our intelligence
agencies we need to know what happened and the truth needs to come out and the
people that abused it need to be removed one of the most striking moments
occurred today when he was asked about Muller's not one but two glaring
conflicts of interests that are disqualifying Rosenstein so I I don't
know of any conflict of interest with mr. Muller he apparently doesn't read
newspapers because dozens and dozens of law professors and lawyers have written
a myriad of columns explaining the disqualifying conflicts of interest of
robert muller but Rosenstein is either a modern-day Machiavelli or he is the most
oblivious person to ever hold such a high position said to me today the and I
really believed them when they said hey you're trying to do this because you're
undermining Muller then you're missing the whole story but the more important
thing that they said here is is they don't get it that they really believe
that these guys and I'll throw those to Sara that they actually think that they
were better smarter and that they think they're the super Patriots and that we
the people are stupid and that they knew better which is why they had to save
Hillary and had to undermine Trump but now they're calling they undermined they
undermine the American people they undermine the system that our nation is
founded on Sean and just look at the most disparaging comments that struck
and Page said about people that shop at Walmart the American people in
Pennsylvania smell them there's nothing more disgusting well no there's nothing
more than disgusting then thinking that you know everything in thinking that you
know everything and that's the reason why president Trump won let's be honest
people were sick and tired sick and tired of being told they weren't smart
enough they're not good enough they don't know what to do and you know what
the American people said you know what we are smart enough we are good enough
and we don't really care what you have to say because we live in this country
and we're gonna vote for who we want to vote for and if Trump hadn't have won if
Trump would not have won this election think of
about what the alternative would be we would never know what happened
